1. INTRODUCTION

 

Thank you for using YBNW (the "Platform"). Please read these Terms and Conditions carefully before using the Platform. By using the Platform, you (the "User") agree to be bound by these Terms and Conditions and our Privacy Policy, which is incorporated herein by

2. USE OF PLATFORM

 

The Platform is a platform that allows users to create groups, post content, and engage in discussions with other Users. The Platform is intended for use by individuals aged 18 and over. By using the Platform, you represent and warrant that you are at least 18 years 

old.

 

3. CONTENT POSTED ON PLATFORM

 

a) You are solely responsible for any content that you post on the Platform, including any information, data, text, comments, or other materials (collectively, "Content"). You must not post any Content that is unlawful, racist, sexist, abusive, threatening, or 

harmful to any individual or group.

 

b) You grant YBNW a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute any Content that you post on the Platform. This license is free of charge and perpetual, but it does not give us the right to sell or otherwise commercialize

your Content.

 

c) You are responsible for ensuring that any Content you post on the Platform does not infringe the intellectual property rights of any third party. If we have reason to believe that any Content violates these Terms and Conditions or applicable laws, we reserve the 

right to remove it from the Platform.

 

4. GROUPS

 

a) You may create groups on the Platform for personal use only. You are responsible for managing your group and ensuring that its content complies with these Terms and Conditions.

 

b) You must not use the Platform to create a group that promotes or facilitates any illegal activity, including but not limited to terrorism, child pornography, rape, or real-life harmful threats.

 

c) YBNW reserves the right to remove any group from the Platform if it violates these Terms and Conditions or applicable laws.

 

5. USER CONDUCT

 

a) You must not use the Platform for any illegal or unethical purpose, including but not limited to hacking, phishing, spamming, or spreading malware.

 

b) You must not post any Content that is defamatory, libelous, or obscene.

 

c) You must not engage in any activity that disrupts the normal functioning of the Platform or interferes with other Users' use of the Platform.

 

d) YBNW reserves the right to remove any User from the Platform if they violate these Terms and Conditions or applicable laws.

 

6. PRIVACY POLICY

 

Please refer to our Privacy Policy for information on how we collect, use, and protect your personal data when you use the Platform. By using the Platform, you consent to the collection and use of your personal data as set forth in our Privacy Policy.

 

7. CHANGES TO TERMS AND CONDITIONS

 

YBNW reserves the right to modify these Terms and Conditions at any time without notice. Your continued use of the Platform constitutes your acceptance of any changes to these Terms and Conditions.

 

8. DISPUTE RESOLUTION

 

a) Any dispute arising out of or related to these Terms and Conditions will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

 

b) The parties will select one neutral arbitrator who is a lawyer with experience in Internet law. The arbitrator will review the evidence presented by both parties and make a final determination on the dispute.

 

c) The prevailing party will be entitled to recover its reasonable attorney fees, expert witness fees, and other costs associated with the arbitration from the non-prevailing party.

 

9. GOVERNING LAW

 

These Terms and Conditions will be governed by and construed in accordance with the laws of the Netherlands, without giving effect to any principles of conflicts of law. Any legal suit, action or proceeding arising out of or related to these Terms and 

Conditions will be brought exclusively in the federal or state courts located in Los Angeles County, California, and you hereby consent to personal jurisdiction and venue in such courts.

 

10. ENTIRE AGREEMENT

 

These Terms and Conditions constitute the entire agreement between you and YBNW regarding your use of the Platform. These Terms and Conditions supersede any prior agreements, representations, or warranties, whether written or oral.

 

By using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, please do not use the Platform.
